NEW REPORT FINDS ALEC WANTS TO UNDERMINE OUR COURTS

Report finds corporate lobbyists are working with elected officials to deny Pennsylvanians justice

HARRISBURG, PA  -- A new report by Keystone Progress has found that American Legislative Exchange Council (ALEC) is public enemy number one when it comes to ensuring justice in Pennsylvania. By relying on several investigations by groups such as Common Cause and the Center for Media and Democracy and ALEC's own official reports, Keystone Progress has found that ALEC, its special interests lobbyists and elected official members want to strip away our civil justice rights.

"This new report digs deeper into ALEC and investigates the dangerous work its members are doing to undermine our courts" Keystone Progress Executive Director Michael Morrill said. "Pennsylvania Attorney General Linda L. Kelly and other Pennsylvania lawmakers need to take note and investigate the nefarious work this organization is accomplishing in Pennsylvania."

The new report, Justice Denied, finds that ALEC has created a stealth legislature in Pennsylvania, bringing together corporate lobbyists and elected state legislators who meet behind closed doors to initiate corporate-friendly bills to introduce, sometimes verbatim, into our General Assembly.  
A few other highlights of the report's findings includes:
  • As part of their ALEC Civil Justice Task Force work, "Crown Holdings Corporation spent over "$100,000 in an attempt to influence the [Pennsylvania] state legislature" over the span of three months in an effort to escape responsibility for asbestos related worker injuries and death.

  • Bucks County Judge Robert J. Mellon declared a "reevaluation of the constitutionality of the statutory cap on damages...is necessary." Furthermore, due to its severely harmful nature to the public the Philadelphia Bar Association has even officially declared it is against any or all attempts to enact legislation to create caps on noneconomic damages. ALEC's work is attempting to go directly against Judge Mellon's wishes.

  • Because of public outrage over ALEC's infiltration into Pennsylvania's legislature, at least 18 Pennsylvania legislators have separated from ALEC. However, 48 Pennsylvania legislators are still listed as ALEC supporters and members.
Keystone Progress issued a report on ALEC's work in Pennsylvania in August 2011. That report showed examples of legislators introducing word-for-word copies of bills created by ALEC's special interests lobbyists.
